1. Agreement to Terms

By accessing or using Vision Cloud services ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

These Terms apply to all users of the Service, including without limitation users who are browsers, vendors, customers, merchants, and contributors of content.

VisionTech Marketing (F.Z.C) ("we," "us," "our") operates the Vision Cloud storage platform and is responsible for providing the services described in these Terms.

3. Account Registration

To use our Service, you must:

  • Be at least 13 years of age
  • Provide accurate and complete registration information
  • Maintain the security of your password and account
  • Accept all risks of unauthorized access to your account
  • Notify us immediately of any unauthorized use

You are responsible for all activities that occur under your account. We reserve the right to refuse service, terminate accounts, or cancel orders at our sole discretion.

4. Subscription Plans and Billing

4.1 Plans and Pricing

We offer multiple subscription plans with different storage capacities and features. Current pricing and plan details are available on our website. We reserve the right to modify our pricing with 30 days' notice to existing subscribers.

4.2 Payment

  • All payments must be made in advance of each billing period
  • We accept major credit cards (Visa, Mastercard, American Express)
  • Billing occurs monthly or annually based on your selected plan
  • Failed payments may result in service suspension
  • All prices are in US Dollars (USD) unless otherwise stated

4.3 Automatic Renewal

Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You will be charged using your payment method on file.

5. Cancellation and Refunds

5.1 Cancellation

You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of the current billing period. You will retain access to your account until the end of the paid period.

5.2 No Refund Policy

All sales are final. Due to the nature of our digital services and instant access to cloud storage resources, we do not offer refunds for any purchases, including but not limited to:

  • Monthly or annual subscription plans
  • GPU cloud computing services (hourly or monthly)
  • Premium add-ons and upgrades
  • One-time services and professional services
  • AI services and credits
  • Proxy services and maintenance packages
  • Renewal charges

By making a purchase, you acknowledge and agree to this no-refund policy. We encourage you to carefully review the service details before completing your purchase.

6. Acceptable Use Policy

You agree NOT to use the Service to:

  • Store or share illegal, harmful, or offensive content
  • Violate any intellectual property rights
  • Upload malware, viruses, or malicious code
  • Harass, abuse, or harm other users
  • Spam or engage in unsolicited marketing
  • Attempt to gain unauthorized access to our systems
  • Share copyrighted material without permission
  • Use the service for any illegal activities

Violation of this policy may result in immediate account termination without refund.

7. Data Storage and Security

We implement industry-standard security measures to protect your data:

  • 256-bit AES encryption for all files at rest and in transit
  • Secure data centers with physical and network security
  • Regular security audits and monitoring
  • Redundant backups to prevent data loss

However: While we take every reasonable precaution, no security system is impenetrable. You are responsible for maintaining secure passwords and protecting your account credentials.

We recommend maintaining local backups of important files as an additional precaution.

8. Storage Limits and File Retention

Each subscription plan includes a specific storage capacity. If you exceed your storage limit:

  • You will be notified via email
  • You must delete files or upgrade your plan within 30 days
  • Failure to comply may result in new uploads being blocked
  • We reserve the right to delete files after 60 days of exceeding limits

Upon account cancellation or deletion, your files will be retained for 30 days before permanent deletion. After deletion, files cannot be recovered.

9. Intellectual Property

Your Content: You retain all rights to the content you upload. By using our Service, you grant us a limited license to store, backup, and display your content solely for the purpose of providing the Service.

Our Platform: The Service, including its original content, features, and functionality, is owned by Vision Digital Services LLC and is protected by international copyright, trademark, and other intellectual property laws.

10. Limitation of Liability

To the maximum extent permitted by law, VisionTech Marketing (F.Z.C) shall not be liable for:

  • Any indirect, incidental, special, or consequential damages
  • Loss of profits, data, or business opportunities
  • Service interruptions or data loss
  • Unauthorized access to your account due to your negligence
  • Third-party actions or content

Our total liability for any claim shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

11. Service Availability

We strive to maintain 99.9% uptime, but we do not guarantee uninterrupted service. The Service may be temporarily unavailable due to:

  • Scheduled maintenance (with advance notice)
  • Emergency repairs or upgrades
  • Events beyond our control (natural disasters, network failures, etc.)

We are not liable for any damages resulting from service unavailability.

12. Privacy and Data Protection

Our Privacy Policy explains how we collect, use, and protect your personal information. By using the Service, you consent to our privacy practices as described in the Privacy Policy. We comply with GDPR and other applicable data protection regulations.

13. Termination

We may terminate or suspend your account immediately if:

  • You violate these Terms or our Acceptable Use Policy
  • Your account is used for fraudulent or illegal activities
  • Your payment method fails repeatedly
  • We are required to do so by law

Upon termination, your right to use the Service will immediately cease. We may delete your data after 30 days.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the new Terms.

15. Governing Law and Disputes

These Terms are governed by the laws of the United Arab Emirates. Any disputes shall be resolved in the courts of Dubai, UAE.

Before filing a lawsuit, you agree to attempt to resolve disputes through negotiation or mediation.
